Earnhardt v. Earnhardt over family name

Teresa Earnhardt, widow of NASCAR Hall of Famer and seven-time Winston Cup champion Dale Earnhardt continues her battle against the late Earnhardt’s oldenst son, Kerry Earnhardt, in an effort to prevent him and wife Rene from using the name “Earnhardt Collection” for a line of homes the couple designs for home builder Schumacher Homes.
“Rene and I have worked extremely hard to develop the Earnhardt Collection brand and make it uniquely ours,” Kerry Earnhardt told ESPN. “I chose to leave a successful career in racing and could not be happier with what we’ve been able to achieve in the five years we’ve been building our home lifestyle brand inspired by our love of the outdoors.”
Kerry Earnhardt is the son of Dale Earnhardt and his first wife Latane. Kerry was adopted by Latane’s second husband, but as a teenager renewed ties with his biological fathers and returned to the Earnhardt name. Teresa Earnhardt was Dale Earnhardt’s third wife after marrying the future NASCAR legend in 1982.
Teresa’s initial motion in an attempt to prevent Kerry and Rene Earnhardt from trademarking the moniker “Earnhardt Collection” was rejected, so she has filed an appeal in a U.S. patent court, claiming that the name could create confusion, resulting in fans and potential customers from relating the “lifestyle brand” to her late husband.
Kelley Earnhardt-Miller, daughter of Dale Earnhardt and his second wife Brenda (Gee) Jackson, handles business matters for her brother Dale Earnhardt Jr., also a child of Dale and Brenda, testified that she hasn’t seen any confusion between the “Earnhardt Collection” line of homes and Earnhardt Jr. Earnhardt Jr. has been NASCAR’s most popular driver since their father’s death.
“Hate that my brother & family have to deal w/ this nonsense for over 4 yrs,” Earnhardt-Miller (@EarnhardtKelley) tweeted. “It’s our name too! We were borth w/ it!”
Teresa and Dale Earnhardt had one child together, a daughter named Taylor. According to all three of her step-children, Teresa has had no relationship with them.
